An open letter to Nintendo concerning SOPA

Nintendo’s contact form is here.

To whom it may concern,

Let me start by saying that I have greatly enjoyed many of Nintendo’s products over the years, from the NES to the Wii. Your company has provided me with lots of fond memories throughout both my childhood and adulthood. A vast majority of the videogame collection I own also happens to be products published by Nintendo.

It has come to my attention that the Entertainment Software Association (which your company is a member of) is publicly listed as a supporter of the Stop Online Piracy Act (HR 3261) according to a document released by the US House Judiciary Committee. Although I do not condone online piracy, I am seriously concerned that this legislation would be open to abuse and stifle free speech on the Internet all in the name of stopping software pirates who are unlikely to buy product in the first place. The federal government already has sufficient legal tools for intellectual property holders to go after people who engage in copyright infringement, and that in itself already has a record of being abused. The ability to shut down websites with merely a claim without a court order is too much power for any company or individual to be given, and is nothing more than a license for censorship.

Although I have heard news that your company is no longer listed as a direct public supporter of SOPA, the ESA’s actions are still unacceptable in my eyes, and I ask you to reconsider your membership in an organization that supports legislation which will likely harm free speech on the internet.

If you continue your membership with the ESA, and if the ESA does not withdraw their support for the Stop Online Piracy Act, not only will I indefinitely boycott your company, but I will sell all of your products I own and donate a significant portion of the proceeds to the Free Software Foundation and the Electronic Frontier Foundation in Nintendo’s name. These organizations truly take the property and 1st amendment rights of consumers to heart, and don’t push others around in an effort to fill out their bottom line. I will also be publicly posting my writings and encourage everyone I know to boycott your products.

Thank you for your time.

Sincerely,

Michael Spafford
